Do I Qualify if I Received a Shot BEFORE My 2016 Exposure to HAV?

If you received the HAV vaccine BEFORE (rather than AFTER) you were exposed to the Hepatitis A virus as a result of the 2016 Hepatitis A Outbreak*, then you are NOT a member of the Settlement Class and you should NOT submit a Claim Form.

For example, if on August 10, 2016, you dined at one of the Genki Sushi restaurants implicated in the HAV outbreak, and afterwards you did not obtain preventative medical treatment because you previously had received the HAV vaccine, then you should not submit a Claim Form. You do not qualify as a member of the Settlement Class.

In this example, even though you were exposed to HAV and you received the HAV vaccine, you are not a member of the Settlement Class because the shot you received was not as a result of the 2016 Hepatitis A Outbreak. The Settlement is limited to persons who received medical treatment as a result of the 2016 Hepatitis A Outbreak. 

*The 2016 Hepatitis A Outbreak was linked to the consumption of food at thirteen Genki Sushi restaurants located on the islands of Oahu, Kauai, and Maui.
